Terms of Service for Next Level Golf

1. Acceptance of Terms

By using Next Level Golf, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the App.

2. Description of Service

The App provides users with the ability to upload videos of their golf swing, receive feedback, access golf-related content, and interact with other users.

3. User Accounts

To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

4. Payment Terms

Use of the app requires payment for video analysis submissions. All payments are processed through a secure third-party payment processor. Subscription fees are billed on a recurring basis. You can cancel your subscription at any time, but refunds are not provided for partial subscription periods.

5. User Content

You are solely responsible for the videos of your golf swing that you upload to the App ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content within the App for the purpose of providing our services.

You agree that your User Content will not:

• Be illegal, harmful, or offensive.
• Infringe on the intellectual property rights of others.
• Violate the privacy of others.

We reserve the right to remove any User Content that violates these Terms.

6. Intellectual Property

The App and its content, including but not limited to text, graphics, logos, and software, are owned by Next Level Golf and are protected by copyright and other intellectual property laws. You may not use our intellectual property without our express written permission.

7. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in a way that could damage, disable, or impair our servers or networks.
• Attempt to gain unauthorized access to the App or other users' accounts.
• Engage in any activity that could disrupt or interfere with the App's functionality.
• Upload or transmit viruses or other malicious code.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXT LEVEL GOLF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

We may terminate your access to the App at any time, with or without cause. You may terminate your account at any time by reaching out to us via email.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Next Level Golf's app, without regard to its conflict of law provisions.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on the App or by sending you an email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
